The short version
Flocara is a marketplace that helps car owners find and communicate with independent automotive-service businesses and discover automotive clubs and events through Lifestyle. Flocara does not perform repairs, employ the businesses listed on the Service, guarantee their work, or process customer-to-business payments. The Service is currently free. When a customer accepts an offer, the service arrangement is between that customer and the selected business.
These Terms of Service ("Terms") form a binding agreement between you and Flocara LLC ("Flocara," "we," "us," or "our") governing your access to and use of Flocara. Please read them carefully.
1. Acceptance and eligibility
By creating an account, selecting the acceptance checkbox, or continuing to use the Service after accepting a required revision, you agree to these Terms and acknowledge the Privacy Policy. If you use Flocara for a business or organization, you represent that you are authorized to bind it, and "you" includes that business or organization.
- Age. You must be at least 18 years old to create an account or use the marketplace.
- United States only. Flocara is offered for use in the United States. You may not use it where doing so would violate applicable law.
- Privacy Policy. Our Privacy Policy explains how we collect, use, share, and retain information and is incorporated into these Terms by reference.
Read the Flocara Privacy Policy.
2. Accounts and business workspaces
You must provide accurate, current information and keep it updated. You are responsible for safeguarding your password, verification methods, recovery codes, signed-in devices, and account activity. Notify us promptly if you suspect unauthorized access.
- One person, authorized use. Do not impersonate another person, create accounts for deceptive purposes, sell or transfer an account, or share access except through Flocara's authorized business-workspace features.
- Workspace responsibility. A business owner controls workspace invitations and permissions and is responsible for selecting authorized members. Workspace members may act only within their granted permissions and authority.
- Session security. You may review and revoke sessions in the Service. Changing a password or disabling multi-factor authentication may revoke other sessions for security.
Where available, you may connect optional Apple/Google sign-in methods or passkeys. Keep access to your chosen sign-in and recovery methods. Matching email addresses do not by themselves merge accounts. Disconnecting a method does not close your account with that external provider.
3. Flocara's marketplace role
Flocara provides technology for publishing service requests, matching businesses, exchanging offers and messages, managing service progress, and sharing reviews. Flocara is not an automotive repair shop, dealer, insurer, employer, broker, agent, fiduciary, or party to the service arrangement between users.
A business's approval or access status means only that Flocara has permitted the account to use business features. It is not an endorsement or a guarantee of identity, licensing, insurance, qualifications, availability, safety, pricing, workmanship, or results. Users must make their own decisions and perform any checks appropriate to the service.
4. Requests, offers, and service arrangements
- Customer requests. Customers must provide accurate descriptions, vehicle information, location, timing, media, and other details reasonably needed for a business to evaluate the requested work. Requests saved for later are not published to businesses.
- Business offers. A business may propose a service date or range, estimated time, estimated price, and message. Unless the users clearly agree otherwise, these are good-faith estimates rather than guarantees.
- Acceptance. Accepting an offer selects the business and creates the service arrangement between the customer and that business. Flocara is not a party to that arrangement.
- Progress and estimates. Businesses may start work, update status, revise an estimated completion date, add a reason, complete work, or cancel as permitted by the Service. Calendar projections and completion estimates are informational and may change due to schedule, parts, vehicle condition, availability, or other circumstances.
- Completion confirmation. When a business marks a service complete, the customer has three days (72 hours) to confirm completion or reject it with a reason. Rejection returns the work to in progress. If the customer does not respond by the deadline, Flocara automatically confirms completion in the workflow. This workflow status does not itself certify satisfactory work, settle a dispute, waive a warranty, or remove legal rights.
- User responsibilities. The customer and business are responsible for confirming the scope, authorizations, access to the vehicle, price, taxes, payment method, warranties, cancellations, completion, pickup or delivery, and any documents required by law.
- Support. Flocara's resolution-center and support features help users communicate about a request. They do not create an escrow, guarantee a refund or outcome, or make Flocara an arbitrator of the underlying service dispute.
4A. Lifestyle clubs and events
Lifestyle lets users discover automotive events, follow organizers, join clubs, RSVP, discuss events, and apply to display or participate with a vehicle where offered. Organizer approval and event review are platform access and content-review decisions, not certification that an organizer, venue, route, vehicle, or activity is safe, licensed, insured, or lawful.
Organizers must accept and follow the Lifestyle guidelines before submitting their organizer application. The guidelines apply to clubs, event submissions, and participation alongside these Terms. Organizers must provide accurate information, obtain necessary venue permissions, permits and insurance, publish relevant eligibility and safety requirements, protect participant information, and promptly communicate important changes or cancellations. Each event must be submitted for review; editing a published event may require a new review.
Members and participants must follow applicable laws and posted event/venue rules, respect others, and make their own safety and attendance decisions. Unlawful street racing, reckless driving, takeovers, trespassing, harassment, and deceptive event listings are not permitted. Do not use Flocara chat or reports for emergencies; contact 911 or the appropriate local emergency service.
Public listings can be discoverable by others. Private club events restrict access within Flocara but do not guarantee confidentiality or stop an authorized participant from sharing information. An RSVP, club membership, or vehicle application is not a ticket, entry guarantee, payment, insurance coverage, or assurance that an event will happen. A vehicle application requires the organizer's decision where approval is offered.
An organizer may display a USD ticket price and link to an external payment or registration website. Flocara does not sell or process tickets, collect payment-card details, validate admission, or administer refunds. Confirm price, eligibility, cancellation and refund terms directly with the organizer or external provider before paying. Nothing here removes any non-waivable rights against a responsible party.
4B. Business client connections
Businesses may use Clients to organize their existing Flocara customers and the service history involving that business. Accepting a business's offer may add the customer to its client directory. A business may also invite an existing Flocara account to connect; an invitation alone does not give it additional private garage or contact information. Archiving a client does not cancel services or erase existing requests, conversations, or other retained records.
You may also choose to connect with a business by explicitly sharing selected vehicles for prospective automotive services, including after adding the business to your favorites. Saving a favorite alone does not create this connection or share private garage or contact information. You choose which vehicles to share and confirm that choice separately. A customer-initiated connection or garage-sharing choice is not a booking, acceptance of an offer, confirmation that a service has occurred, or permission for unrelated marketing. The same business-workspace access and withdrawal rules apply to these connections.
A customer may separately choose vehicles and contact details to share with a connected business. Sharing is optional and read-only; it does not transfer vehicle ownership or authorize the business to edit the customer's garage or submit requests on the customer's behalf. Additional vehicles are not shared automatically. The customer can change or stop ongoing sharing in Settings > Business sharing. Stopping sharing does not retract information already included in service requests or conversations, erase legitimate retained service history, or recall copies already obtained.
Business connections and authorized access belong to the business entity, not an individual owner's personal account. Authorized workspace members may access information according to their permissions, and business-scoped connections and records remain with the business if its ownership changes. If the customer is itself a business, its current owner or authorized garage/profile manager controls sharing from that business's garage. Personal credentials, personal garages, and unrelated private conversations do not transfer with business ownership.
Businesses must use client information only for the automotive-service relationship and other purposes separately permitted by the customer and applicable law. A connection or garage-sharing choice is not consent to unrelated marketing, resale, or public disclosure. Businesses remain responsible for their authorized personnel and their handling of information they receive.
5. Business responsibilities
A business and its authorized workspace members must operate lawfully and professionally. The business is solely responsible for its services and personnel, including:
- Authority and compliance. Maintaining all registrations, licenses, permits, insurance, qualifications, tax records, and other requirements applicable to its work and location.
- Repair documentation. Providing estimates, approvals, disclosures, invoices, warranties, notices, and records required by applicable automotive-repair and consumer-protection laws.
- Accurate presentation. Keeping its profile, service categories, tags, location, contacts, service area, schedule, availability, offer details, and progress updates accurate.
- Safe performance. Using appropriately qualified personnel, obtaining customer authorization, protecting vehicles and personal information, and performing work safely and in accordance with applicable standards.
6. Complimentary access and future paid services
Flocara currently provides access to the Service without charging a platform membership fee. This complimentary access is the current offering and is not a free trial that automatically converts to a paid subscription. Flocara does not currently collect billing information or process payments between customers and businesses. Any service payment, deposit, refund, chargeback, tax, warranty, or financing arrangement is handled directly between the customer and business, and Flocara is not responsible for it.
Flocara may later introduce paid memberships, premium features, optional add-ons, advertising products, or other paid offerings and may designate some features as available only under a paid plan. Before any charge, Flocara will clearly present the applicable price, billing frequency, included features, material restrictions, duration or renewal terms, and cancellation method, and will obtain any consent required by law.
Complimentary access will not automatically convert to a paid plan, and the end or modification of complimentary access does not by itself authorize a charge. A user or business that does not affirmatively enroll in a paid offering will not be charged for it. Flocara will not impose retroactive fees for past use of complimentary access.
Flocara may add, modify, limit, or discontinue complimentary features as described in Section 20. Flocara may also offer separate written promotional or partner-program terms to eligible accounts. Those additional terms will identify the applicable eligibility, duration, included benefits, exclusions, transferability, and termination conditions. If specific program terms conflict with these Terms, the program terms control only for that program benefit.
7. Your content
You retain ownership of content you submit, including profile information, request descriptions, messages, reviews, reports, organizer/club profiles, event listings, participant rules, and photos or videos. You represent that you have the rights and permissions needed to submit it and that it does not violate law or another person's rights.
You grant Flocara a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, format, transmit, and display your content only as reasonably needed to operate, secure, moderate, support, and improve the Service and to make content available to the users and providers involved in those functions. This license ends when the content is deleted from active systems, subject to reasonable backup, evidence, integrity, and legal-retention periods described in the Privacy Policy.
We will not use private chats or private request media as a public endorsement without permission. Public profile, club, event, and review content may be displayed within Flocara as part of the marketplace.
8. Reviews and ratings
Reviews must be truthful, relevant, and based on a genuine interaction. You may not submit or arrange fake reviews, fabricate an experience, condition compensation on positive or negative sentiment, manipulate ratings, or post a review about a business or person with an undisclosed material connection that would make the review misleading.
We may investigate, hide, or remove reviews that violate these Terms, regardless of whether they are favorable or unfavorable. When an account is deleted, review text and media authored by that user may be removed while limited aggregate rating values may remain to preserve marketplace integrity, as explained in the Privacy Policy.
After completion is confirmed by the customer or automatically after the confirmation deadline, each party may optionally review the other. Review reminders run for up to 15 days; this is a reminder period, not a deadline for submitting a review. Client and contractor ratings are tracked separately. Review prompts are available from completed requests; reminders may be sent immediately and after 3, 7, and 12 days, subject to notification settings. Review-reminder notifications are removed from the notification center when the corresponding review is submitted.
If a party does not submit a review, Flocara does not create a new rating or review on that party's behalf. When the reminder period ends, reminders stop. Silence is not evidence of satisfaction or proof of the quality of a service.
Legacy entries labeled "Automated Flocara review" may remain in existing histories and displayed rating aggregates. They are system-generated defaults, not ratings or written opinions actively submitted by a customer or business. The original reviewer may replace a legacy entry with their own review; the other party's review is not replaced.
9. Acceptable use
You may not use Flocara to:
- Break the law or deceive others. Engage in fraud, theft, unlawful services, impersonation, deceptive offers, false business information, or misleading reviews.
- Abuse people or the platform. Threaten, harass, exploit, stalk, discriminate against, or direct hate or severe abuse toward another person or group; send spam; or repeatedly contact someone who has asked you to stop.
- Violate rights. Infringe intellectual-property, privacy, publicity, confidentiality, or other rights, or upload content you are not authorized to share.
- Compromise security. Introduce malware, probe or bypass security or permissions, evade rate limits, scrape or harvest data, reverse engineer except where law expressly permits it, interfere with the Service, or access another account or private content without authorization.
- Misuse information. Use request, profile, chat, report, diagnostic, or location information for an unrelated purpose or disclose another person's sensitive information unnecessarily.
Ordinary profanity used to describe a vehicle condition or requested service is not automatically prohibited. Directed threats, hateful attacks, targeted harassment, or unlawful content are prohibited.
10. AI and automated features
Flocara may use automated systems and artificial intelligence to summarize request text, suggest titles, classify categories or tags, extract request details, assist matching, and identify directed abuse or threats. These outputs may be incomplete or wrong. You must review important information and should not rely on an automated title, category, match score, estimate, or safety result as professional automotive, legal, insurance, financial, or safety advice or as a guarantee of outcome.
These AI features use OpenAI. With your explicit permission, Flocara sends request text and relevant vehicle make/model/year, location and timing context, or the business description being analyzed, to OpenAI for analysis and categorization before the applicable review process. Uploaded photos and videos are not sent by these features. The separate permission prompt, not acceptance of these Terms alone, authorizes that sharing. The Privacy Policy explains the information and consent record.
You can cancel the permission prompt or withdraw permission in Settings > Security for future analysis. Flocara stores the agreement flag, last agreement date/time, and disclosure version. AI analysis is required for the affected request and business-description steps; those steps cannot be completed without permission, and no manual-only alternative is currently offered. Withdrawal does not undo already completed analysis or recall data already sent.
11. Communications and notifications
You agree to receive electronic communications needed to operate and secure your account, including verification codes, request-completion and review reminders, workspace and Lifestyle updates, support messages, security notices, account-deletion notices, and legal-document updates. Depending on your settings and device, communications may arrive in Flocara, by email, SMS, browser push, or mobile push. Carrier and data rates may apply.
Optional email categories are unchecked by default; you may enable and disable them in notification settings. Push requires the applicable device/browser permission as well as the channel preference. Essential verification, security, account-deletion, and legal notices are separate from optional activity notifications and may still be sent. Email delivery uses Microsoft Azure Communication Services Email or the configured SendGrid alternative. US SMS verification uses Twilio Verify when enabled. Delivery and device availability are not guaranteed, so check the Service for time-sensitive deadlines.
12. Reports, moderation, and enforcement
Users may report profiles, messages, reviews, Lifestyle content, and request- or event-related problems through available reporting tools or support. We may review content and account history, preserve evidence, contact affected users, hide or remove content, restrict features, suspend or terminate accounts, or refer urgent matters to appropriate authorities when reasonably necessary to enforce these Terms, protect users, maintain security, or comply with law.
We are not required to monitor every interaction and cannot guarantee that every report will be resolved to a user's satisfaction. Administrative action is a platform decision and does not determine legal liability between users.
13. Flocara intellectual property
The Service, software, interface, Flocara name and logos, and other Flocara-provided materials are owned by or licensed to Flocara and are protected by intellectual-property laws. Subject to these Terms, Flocara grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for its intended purpose. No other rights are granted.
To report alleged infringement, email support@flocara.com with your contact information, identification of the protected work, identification and location of the challenged material, a good-faith explanation, and a statement that the information supplied is accurate and that you are authorized to act.
14. Third-party services and app stores
Flocara relies on third-party hosting, maps, artificial-intelligence, email, SMS, push-notification, app-store, and other services. Their terms and privacy practices may apply to your use of their products. Flocara is not responsible for an external service outside our control.
Apple App Store terms
- Parties and license. These Terms are between you and Flocara, not Apple. Apple is not responsible for the iOS application or its content. Your license is non-transferable and permits use on Apple-branded products that you own or control as allowed by the Apple Media Services Usage Rules, including permitted Family Sharing or volume-purchase use.
- Support and warranty. Flocara, not Apple, is responsible for maintenance and support. To the maximum extent allowed by law, the application is provided without warranty. If it fails to conform to an applicable warranty, you may notify Apple and Apple may refund any purchase price paid for the application; because Flocara is currently free, that amount is $0. Apple has no other warranty obligation.
- Claims and intellectual property. Flocara, not Apple, is responsible for addressing claims relating to the application, including product-liability, legal or regulatory, consumer-protection, and intellectual-property-infringement claims.
- Compliance. You represent that you are not located in a country subject to a United States government embargo or designated as supporting terrorism and are not listed on a United States government restricted-party list.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-related provisions against you after you accept them.
Other distribution platforms
If you obtain Flocara through Google Play or another distribution platform, you must also comply with that platform's applicable terms. The platform is not responsible for Flocara except to the extent its own terms or applicable law expressly provide otherwise.
15. Account deactivation and termination
- Deletion requested by you. You must first complete or cancel active service obligations as required by the Service. Starting deletion deactivates the account immediately and begins a seven-day cancellation period. If not cancelled, final deletion removes or anonymizes information as described in the Privacy Policy; retained conversations become read-only and identify the account as a deleted user.
- Action by Flocara. We may restrict, suspend, or terminate access when we reasonably believe you violated these Terms, pose a security or safety risk, create legal exposure, misuse the Service, or when required by law. Where appropriate, we may give notice and an opportunity to address the issue.
- Effect. Termination ends your license to use the Service. Provisions that by their nature should survive will remain in effect, including ownership, retained content licenses, marketplace obligations already undertaken, disclaimers, liability limits, indemnity, dispute terms, and general provisions.
16. Disclaimers
Please read this section carefully
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOCARA AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE." FLOCARA DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR AVAILABLE AT A PARTICULAR TIME, OR THAT ANY USER, BUSINESS, MATCH, OFFER, ESTIMATE, PRICE, SCHEDULE, REVIEW, VEHICLE SERVICE, OR RESULT WILL BE ACCURATE, SAFE, LAWFUL, AVAILABLE, OR SATISFACTORY.
Some jurisdictions do not allow certain warranty exclusions. These exclusions apply only to the extent permitted by law and do not waive rights that cannot legally be waived.
17. Limitation of liability
Liability limits
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOCARA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE, ANOTHER USER, OR AN AUTOMOTIVE SERVICE ARRANGEMENT. FLOCARA'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID DIRECTLY TO FLOCARA DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits do not apply to liability that cannot lawfully be limited, and do not exclude liability for Flocara's gross negligence, willful misconduct, or personal injury caused by Flocara where applicable law prohibits that exclusion.
18. Indemnity
To the extent permitted by law, a business or other person using Flocara for commercial purposes will defend, indemnify, and hold harmless Flocara and its officers, directors, employees, and agents from third-party claims, damages, judgments, losses, liabilities, and reasonable legal fees arising from that user's services, personnel, content, violation of these Terms, violation of law, or infringement of another person's rights. This section does not require indemnity for Flocara's own gross negligence or willful misconduct and does not limit non-waivable consumer rights.
19. Governing law and disputes
Florida law governs these Terms, without regard to conflict-of-law rules. Any lawsuit arising from these Terms or the Service must be brought in a state or federal court located in Broward County, Florida, and each party consents to that court's jurisdiction and venue, except where applicable consumer law requires otherwise.
Before filing a claim, please send a written description to support@flocara.com and allow 30 days for a good-faith effort to resolve it. This does not prevent either party from seeking urgent injunctive relief, complying with a legal deadline, or using a forum or remedy that cannot lawfully be waived. These Terms do not require arbitration and do not include a class-action waiver.
20. Changes to the Service or these Terms
We may change, add, suspend, or discontinue Service features. We may also revise these Terms when the Service, our practices, or legal requirements change. For a material revision, Flocara may send an in-app notification and specify a review deadline. The Service may restrict account access after that deadline until the current revision is reviewed and accepted. The date at the top identifies this revision.
Separately identified testing versions may use a testing environment. Requests, offers, messages and account-setting changes made there are for testing and do not update the live marketplace. Testing access is not a promise of production availability or completion of a real-world service.
21. General terms
- Entire agreement. These Terms, the Privacy Policy, and any additional terms presented for a specific feature are the entire agreement between you and Flocara regarding the Service. Specific additional terms control only for that feature if they conflict with these Terms.
- Severability. If a provision is unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will continue in effect.
- No waiver. A failure to enforce a provision is not a waiver of the right to enforce it later.
- Assignment. You may not assign these Terms without Flocara's written consent. Flocara may assign them in connection with a merger, financing, reorganization, sale of assets, or transfer of the Service, subject to applicable law.
- Force majeure. Flocara is not responsible for delay or failure caused by events beyond reasonable control, including disasters, outages, cyberattacks, labor disputes, governmental actions, or failures of telecommunications and third-party infrastructure.
- Headings. Headings are for convenience and do not affect interpretation.
